I. General Terms

Welcome to The Nail Spa Scottsdale located in Scottsdale, Arizona ("the Salon," "we," "us," or "our"). By scheduling an appointment, purchasing a gift card, or receiving any services at our salon, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These Terms and Conditions constitute a legally binding agreement between you and the Salon. We are a licensed nail salon operating in compliance with the Arizona State Board of Cosmetology (A.R.S. § 32-500 et seq.) and the City of Scottsdale business licensing requirements.

All nail technicians employed by or contracted with our Salon hold valid Arizona cosmetology or nail technology licenses as required by Arizona Revised Statutes.

II. Services & Pricing

We offer a range of nail care services including, but not limited to, manicures, pedicures, gel nails, acrylic nails, nail art, dipping powder, and related beauty treatments. Service descriptions and pricing are available at the Salon and may be updated from time to time.

Prices are subject to change without prior notice. The price quoted at the time-of-service booking is the price that will apply, unless an error has been made. Arizona transaction privilege tax (TPT) will be applied to all services in accordance with Scottsdale and Maricopa County tax rates.

Additional charges may apply for services requiring extra time, specialty products, nail repairs, or intricate nail-art designs. Your technician will inform you of any additional costs before proceeding.

III. Appointments & Cancellations

Appointments are recommended and may be made by phone, online, or in person. Walk-ins are welcome subject to availability.

Cancellation Policy: We kindly request at least 24 hours' notice for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee of up to 50% of the scheduled service price.

No-Show Policy: Clients who fail to arrive within 15 minutes of their scheduled appointment time without prior notice will be considered a no-show. Repeated no-shows (two or more) may result in a requirement to prepay for future appointments or a temporary restriction on booking.

Late Arrivals: If you arrive late, we will do our best to accommodate your full service. However, your appointment may need to be shortened or rescheduled to avoid delays for other clients.

IV. Gift Card Policy

Please carefully review our gift card terms below.

Gift cards are available for purchase in-store and, where offered, online. They may be purchased in any dollar amount and are redeemable for any salon service or retail product.

No Expiration: In accordance with the federal Credit CARD Act of 2009 and Arizona law (A.R.S. § 44-7402), gift cards issued by our Salon do not expire. You may redeem your gift card at any time.

No Fees: We do not charge dormancy fees, service fees, inactivity fees, or any other post-purchase fees on gift cards, consistent with Arizona consumer protection statutes.

Non-Refundable: Gift cards are non-refundable and cannot be exchanged for cash, except where required by applicable law. Under Arizona law, if the remaining balance on a gift card is less than $5.00, you may request a cash redemption of that balance.

Lost or Stolen Cards: The Salon is not responsible for lost, stolen, or damaged gift cards. Gift cards are treated like cash—please safeguard them accordingly. If you can provide proof of purchase (receipt or transaction record), we may issue a replacement at our sole discretion.

Partial Redemption: If the cost of your service or purchase exceeds the gift card balance, you are responsible for the remaining amount. Any unused balance will remain on the card for future use.

Promotional Gift Cards: From time to time, we may offer promotional or bonus gift cards. These may have different terms, including expiration dates and usage restrictions, which will be clearly stated at the time of issuance.

Third-Party Purchases: We are not responsible for gift cards purchased through unauthorized third-party sellers. To ensure validity, please purchase gift cards directly from our Salon.

V. Payment Terms

Payment is due in full at the time when services are rendered. We accept cash, major credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay, Google Pay, and gift cards.

Gratuities are appreciated but never expected. Tips are not included in service pricing and are at the sole discretion of the client. Gratuities may be paid in cash or added to a card payment.

A valid credit card may be required to hold certain appointments. Your card will only be charged in the event of a late cancellation or no-show as described above.

VI. Health, Safety & Sanitation

Your health and safety are our highest priorities. We comply with all Arizona State Board of Cosmetology sanitation and sterilization standards, as well as Maricopa County health regulations.

All metal implements are sanitized and sterilized between each client. Disposable items (files, buffers, toe separators) are used once and discarded. Pedicure basins are thoroughly disinfected after each use in accordance with Arizona Board requirements.

Client Disclosure: For your safety, please inform your technician before your service of any allergies, skin conditions, infections, diabetes, pregnancy, or any other health condition that may affect your nail service. We reserve the right to refuse service if we determine a health risk to you or our staff.

We reserve the right to decline service to any client who appears to have a contagious condition (e.g., fungal infection, open wounds on hands/feet) to protect the well-being of all clients and staff.

VII. Liability & Assumption of Risk

By receiving services at our Salon, you acknowledge that nail services involve inherent risks, including but not limited to allergic reactions, skin irritation, nail damage, and minor cuts. The Salon takes all reasonable precautions to minimize these risks.

The Salon, its owners, employees, and independent contractors shall not be held liable for any injury, loss, or damage arising from services provided, except in cases of gross negligence or willful misconduct.

Service Satisfaction: If you are unsatisfied with your service, please notify us within 48 hours. We will make every reasonable effort to address your concern, which may include a complimentary correction. Refunds are offered at the sole discretion of salon management.

The Salon is not responsible for personal belongings left on the premises. Please keep your valuables with you at all times.

VIII. Client Conduct

We strive to provide a relaxing and welcoming environment for all clients. We expect all clients to treat our staff and other clients with courtesy and respect.

We reserve the right to refuse or discontinue service to any client who engages in disruptive, disrespectful, harassing, or threatening behavior. In such cases, you will be responsible for payment for any services already rendered.

Children under the age of 12 must be accompanied by a parent or guardian at all times. For safety reasons, children are not permitted in the service area unless they are receiving a service.

The use of loud personal devices, including speakerphones, is discouraged in the interest of maintaining a tranquil atmosphere for all guests.

IX. Intellectual Property

All content on our website, social media, and marketing materials—including text, images, logos, nail art designs, and branding—is the intellectual property of the Salon and may not be reproduced, distributed, or used without our prior written consent.

By allowing photographs of your nails to be taken by salon staff, you grant us a non-exclusive, royalty-free license to use those images for marketing and promotional purposes, including on social media and our website. You may opt out of this at any time by notifying us in writing.

X. Arizona Consumer Rights

As a business operating in the State of Arizona, we adhere to all applicable consumer protection laws, including the Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.).

You have the right to transparent pricing and honest representation of our services. If you believe you have been subjected to unfair or deceptive practices, you may file a complaint with the Arizona Attorney General's Office or the Arizona State Board of Cosmetology.

The Salon collects and remits Arizona Transaction Privilege Tax (TPT) on all taxable services and retail products as required by the Arizona Department of Revenue and the City of Scottsdale.

XI. Modifications to Terms

The Salon reserves the right to modify, update, or amend these Terms and Conditions at any time. Changes will be effective immediately upon posting at the Salon or on our website.

Your continued use of our services following any changes constitutes your acceptance of the revised terms. We encourage you to review these Terms periodically.

XII. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law’s provisions.

Any disputes arising out of or relating to these Terms or the services provided by the Salon shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By booking an appointment, purchasing a gift card, or receiving services at our Salon, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
